LANSING, MI — Attorney General Dana Nessel said Friday a ban on guns at the Capitol could be enacted by the Michigan State Capitol Commission, which is slated to discuss firearms next week.

In a letter sent to the Michigan State Capitol Commission, Nessel said the commission would be within its rights to ban guns on the Capitol grounds for the protection of those both inside and outside of the building. MICHIGAN ‘ The Michigan State Capitol Commission has the legal authority to prohibit the presence of firearms in the state Capitol if it so choose to do so, according to the state’s attorney general.

Michigan Attorney General Dana Nessel said the authority to make that decision is consistent with the current state of the law regarding guns in public buildings and sent a letter to the commission informing them of that.

During recent demonstrations at the capitol, many people protested the governor’s stay-home order while carrying guns. The protests lead to some lawmakers and other capitol employees to express that they felt threatened and feared for their safety.

(WWJ) In a’stunning twist,’Michigan Attorney General Dana Nessel says the’Michigan State Capitol Commission can ban guns from the state Capitol building.

Nessel has sent a letter to the Commission confirming that it has the legal authority to prohibit the presence of firearms in the state Capitol, if it chooses to do so. That authority is consistent with the current state of the law regarding firearms in public buildings and an informational letter sent to Speaker Chatfield in 2018.’

AG Dana Nessel: Commission can prohibit firearms at State Capitol

Nessel sent a letter to the commission Friday letting them know they can prohibit firearms if they chose to do so, saying “the authority is consistent with the current state of the law regarding firearms in public buildings and an informational letter sent to Speaker Chatfield in 2018,” according to a press release from Nessel’s office.

In her letter, Nessel said the commission has the legal authority to ensure the “safety of the visiting public, as well as those who carry out the People’s work by prohibiting firearms within the Capitol building.”

The attorney general said that regulation of firearms usually stems from state statute, however, the prohibition of firearms from public spaces does not need to originate from the Legislature.
